1. Agreement to These Terms

By accessing lamigacuracao.com (the "Site") or purchasing from L'Amiga N.V. ("L'Amiga," "we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use the Site or purchase from us.

2. About Our Business

L'Amiga is an audiovisual retail, integration, and rental company based in Willemstad, Curaçao. These terms govern purchases made through the Site and in our store. AV integration projects, installations, and equipment rentals are provided under separate written quotations or agreements; where such an agreement exists, its terms take precedence for the services it covers.

3. Eligibility

By using the Site, you confirm that you are at least the age of majority in your place of residence, or that you have the consent of a parent or guardian, and that you will not use our products or services for any illegal or unauthorized purpose.

4. Products, Pricing & Availability

We make every effort to display our products accurately, but colors and appearance may vary depending on your screen. Product availability is subject to change without notice, and we reserve the right to limit quantities per customer. All prices are listed in Caribbean guilders (XCG) unless otherwise indicated and include applicable sales tax (OB) where required. Occasionally a product may be listed with an incorrect price or description; we reserve the right to correct such errors and to cancel any order affected by them, in which case you will receive a full refund of any amount paid.

5. Orders & Payment

Placing an order constitutes an offer to purchase. We reserve the right to accept or refuse any order, including in cases of suspected fraud, pricing errors, or insufficient stock. Payment is due at the time of ordering through the payment methods offered at checkout. We may request additional information to verify an order before processing it. You will receive a confirmation once your order is accepted.

6. Delivery & Pickup

Orders may be picked up at our store in Willemstad or delivered as arranged at checkout. Delivery timelines are estimates and not guarantees. Responsibility for the product passes to you upon delivery or pickup. Delivery charges, where applicable, are shown before you complete your order.

7. Returns & Refunds

Returns and refunds are governed by our Return & Refund Policy, available on the Site. In summary: returns must be requested within 5 business days, items must be unused and in original packaging, and a 20% restocking fee applies to returns without a valid reason. Please review the full policy before requesting a return.

8. Warranties

Products sold by L'Amiga carry the manufacturer's warranty where applicable, and we will gladly assist you with warranty claims. Except as required by law, we make no additional warranties beyond those provided by the manufacturer. Nothing in these terms limits any rights you may have under applicable consumer protection law.

9. Intellectual Property

All content on the Site, including text, images, logos, and design, is the property of L'Amiga N.V. or its licensors and may not be reproduced or used without our prior written permission.

10. Prohibited Use

You may not use the Site for any unlawful purpose, to violate any regulations or laws of Curaçao or your own jurisdiction, to transmit malicious code, to interfere with the operation of the Site, or to collect data from the Site through automated means without our permission.

11. Limitation of Liability

To the maximum extent permitted by law, L'Amiga's total liability for any claim arising from a purchase is limited to the amount you paid for the product concerned. We are not liable for indirect, incidental, or consequential damages. This limitation does not affect any statutory rights that cannot be excluded under applicable law.

Your submission of personal information through the Site is governed by our Privacy Policy, available on the Site.

13. Changes to These Terms

We may update these Terms of Service from time to time. The current version will always be posted on this page with the date of the latest revision. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.

14. Governing Law

These Terms of Service and any purchase made through the Site are governed by the laws of Curaçao. Any dispute will be submitted to the competent courts of Curaçao.
